Question 7

What type of financial institution is flatexDEGIRO?

Accepted Answer

flatexDEGIRO Bank AG in Austria is an EEA Branch (EWR-Zweigstelle in German) of a German credit institution. This means it operates under the European passporting framework, whereby a bank licensed in one EEA country can establish branches in other EEA countries without requiring a separate Austrian banking license.

The branch is supervised by the Austrian Financial Market Authority (Finanzmarktaufsicht - FMA) for local conduct matters, while prudential supervision remains with Germany's Federal Financial Supervisory Authority (BaFin). As a branch of the German parent institution, it operates as an extension of flatexDEGIRO Bank AG rather than an independent legal entity.

In Austria's banking taxonomy, this structure is classified as a Wertpapierdienstleistungsunternehmen (securities services firm) with banking capabilities. Customer deposits are protected by the German deposit guarantee scheme (Entschädigungseinrichtung deutscher Banken) rather than Austria's deposit insurance system, as protection follows the parent institution's home country scheme.
